Terms of Service

1. Introduction

These Terms of Service constitute a legally binding agreement between the user ("Customer") and VinylSharp ("Company") governing access to and use of the Company's online platform ("Website") and the purchase of any product sold thereon. By accessing or using the Website, the Customer acknowledges that they have read, understood, and agreed to be bound by these Terms. The Customer further affirms that they possess the legal capacity to enter into a contract under applicable Indian law.

2. Eligibility and Account Responsibilities

The Customer must be at least eighteen years old and capable of forming a legally binding contract. The Customer agrees that all information provided during account creation, including name, contact number, email address, and delivery address, shall be accurate and updated as required. The Customer is solely responsible for safeguarding login credentials and shall bear liability for all actions performed through their account.

3. Use of the Website

The Customer shall not misuse the Website for fraudulent activities, attempts to manipulate pricing, exploitation of promotional codes, or any activity that could impair the Website's functionality. The Company reserves the right to monitor usage patterns and terminate or suspend access to any Customer suspected of engaging in prohibited conduct.

4. Product Descriptions and Availability

The Company endeavours to provide accurate product descriptions, specifications, images, and pricing. However, variations in colour, finish, or appearance may occur due to screen differences or lighting conditions. Such variations shall not constitute defects. All products are subject to availability, and the Company reserves the right to modify or discontinue any product without prior notice.

5. Order Placement and Acceptance

A Customer's order constitutes an offer to purchase. An order shall be deemed accepted only upon issuance of an Order Confirmation by the Company. The Company reserves the right to cancel orders arising from pricing errors, technical malfunctions, inability to fulfil the order, or suspected fraudulent behaviours. If payment has been processed prior to cancellation, the Company shall initiate a refund.

6. Pricing and Payment

All prices listed on the Website are inclusive of applicable taxes unless expressly stated otherwise. The Customer agrees to use only authorized payment instruments. The Company shall not be liable for delays or failures arising from payment gateway errors, system downtime, or banking interruptions.

7. Customer Obligations

The Customer agrees to:

• Provide accurate delivery information.
• Ensure availability during scheduled deliveries.
• Inspect products immediately upon delivery.
• Preserve the original packaging until satisfaction with the product is confirmed.
• For fragile items, the Customer agrees to record a continuous, unedited unboxing video to support any damage claims.

8. Intellectual Property

All content on the Website, including text, images, product descriptions, logos, design elements, and layout, constitutes intellectual property owned by the Company. The Customer may not reproduce, adapt, disseminate, or exploit such material without written authorization.

9. Limitation of Liability

The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Website or purchase of products. The Company shall not be responsible for losses arising from courier delays, Customer negligence, misuse of products, or events beyond reasonable control.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.
